These terms govern your access to and use of Binmatic, an operations, customer-management, and automation platform for dumpster-rental and junk-removal businesses. By creating an account or using the service, you agree to these terms on behalf of your business.
Binmatic provides software that helps service businesses manage bookings, dispatch, routing, invoicing, payments, customer communication, reporting, and optional AI-assisted automation. We add and change features over time as the product evolves. Some features rely on third-party services you choose to connect (see “Third-party integrations” below).
You are responsible for the accuracy of the information you provide, for safeguarding your login credentials, and for all activity under your account. You must be authorized to act on behalf of the business you register. Notify us promptly of any unauthorized use. Each business operates in its own isolated workspace.
Two-factor authentication. You may enable two-factor authentication (2FA) using an authenticator app. When 2FA is on, signing in requires a one-time code in addition to your password. You are responsible for keeping your authenticator device and your one-time backup codes secure and accessible; backup codes are shown only once, and each works a single time. The "trust this device" option lets a browser you choose skip the code for a limited period — use it only on devices you control, and revoke it from your security settings if a device is lost. Sign-in sessions remain active while in use and you can review and sign out individual devices at any time. If you lose access to both your authenticator and your backup codes, Binmatic can reset 2FA on your account only after verifying your identity through a reasonable process; we will not disable 2FA on request without such verification. You remain responsible for all activity under your account, with or without 2FA enabled.
You agree not to misuse the service. You will not: (a) break the law or infringe others' rights; (b) attempt to access systems, accounts, or data you are not authorized to reach; (c) interfere with or disrupt the platform; (d) reverse engineer or resell the service except as permitted; (e) upload malicious code; or (f) use the platform to send unlawful, deceptive, or unconsented communications.
You retain ownership of the business and customer data you put into Binmatic ("Customer Data"), which may include information about your customers, employees, contractors, jobs, and finances. You grant us a limited license to host, process, and display Customer Data to operate the service for you and as described in our Privacy Policy. You are responsible for having the rights, notices, and consents required by law to provide Customer Data and to contact the individuals in it.
Binmatic can connect to third-party services you authorize, including:
When you connect a service, you authorize Binmatic to access and use the data needed to provide the features you enable, subject to that provider's terms. Your use of QuickBooks Online is also governed by Intuit's terms; Binmatic accesses your QuickBooks data only as you direct, uses it solely to provide the service to you, and does not control Intuit's services. You may disconnect any integration at any time.
By adding phone numbers or email addresses — yours or your customers' — you authorize Binmatic to send service-related and, where permitted, marketing communications by SMS, voice, and email on your behalf and to your account. You represent and warrant that you have obtained any consents required by law (including the TCPA and CAN-SPAM) from the individuals you contact through the platform, and you will honor opt-out requests. Message and data rates may apply; recipients can opt out (for example, by replying STOP).
Customers who provide a mobile number when booking or requesting service may receive recurring service-related text messages — including booking confirmations, driver and ETA notifications, appointment and rental-pickup reminders, invoices and secure payment links, and post-service feedback requests. Message frequency varies based on your service activity. Message and data rates may apply. Reply STOP at any time to opt out of further messages, and HELP for help — or contact support at support@binmaticai.com. Carriers are not liable for delayed or undelivered messages.
Mobile phone numbers and SMS consent/opt-in information are never sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Such information is shared only with our messaging provider (Twilio) strictly to deliver the messages you have requested or consented to receive. See our Privacy Policy for details.
Payment processing is performed by third-party processors (such as Stripe, PayPal, Square, and others you connect). Binmatic does not store full payment-card numbers. Your use of payment features is subject to the applicable processor's terms, and you are responsible for the accuracy of amounts you charge and the lawfulness of your transactions.
Some features use artificial intelligence to draft messages, summarize activity, suggest actions, and answer questions. AI output is assistive and may be imperfect; a human should review it before customer-facing messages are sent or money-related actions are taken. Binmatic does not provide accounting, tax, legal, or financial advice, and AI output is not a substitute for a qualified professional.
Automation and autonomy. You choose the platform’s autonomy level — from manual approval of every action to fully automated operation — and its automation settings. Actions the platform takes on your behalf at the level you select, including bookings, scheduling, dispatch, customer messages, and money-related actions, are your responsibility as if you had taken them yourself. Where you reduce or turn off human review, you accept the additional risk that comes with automation, and Binmatic is not responsible for the outcomes of automated actions you have enabled.
Binmatic and its operator may own or operate dumpster-rental and junk-removal businesses that also use the platform ("Affiliated Locations"). Where Binmatic owns a business using the platform, Binmatic accesses that business's data as the owner of that business. For independent businesses and franchise locations, Binmatic acts as a service provider, and your data is handled under this Agreement and our Privacy Policy.
You acknowledge and agree that Binmatic may evaluate businesses on the platform for partnership, investment, or acquisition opportunities, using operational and usage data generated through the platform — such as jobs, bookings, payments processed through Binmatic, growth, and efficiency. Any investment or acquisition discussion will be conducted transparently and with your participation.
Accounting-platform carve-out. Binmatic does not use data obtained from connected third-party accounting platforms (such as QuickBooks Online, Xero, FreshBooks, or Wave) for cross-customer analysis, benchmarking, or partnership/investment/acquisition evaluation. Such data is used solely to provide the service to the customer who connected it.
After an acquisition. If Binmatic acquires a business that uses the platform, that business becomes an Affiliated Location owned by Binmatic, and Binmatic thereafter accesses its data as owner.
Franchise networks. For multi-unit and franchise operators, a corporate operator may receive reporting on franchised locations based on operational data generated through the platform; data obtained from connected accounting platforms is not used for that reporting unless the location is owned by the operator.
Paid plans are billed per the pricing presented at signup. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.
Binmatic, including its software, design, and trademarks, is owned by Binmatic LLC and its licensors. These terms grant you a limited, non-exclusive, non-transferable right to use the service; they do not transfer ownership.
The service is provided "as is" and "as available" without warranties of any kind, express or implied. Binmatic does not provide accounting, tax, legal, or financial advice; reports and figures are for management use and should be confirmed with a qualified professional. We do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, Binmatic LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us for the service in the twelve months before the claim.
You agree to defend, indemnify, and hold harmless Binmatic LLC, Binmatic, and our officers, employees, and agents from and against any third-party claims, demands, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the service, including actions the platform takes on your behalf at the automation settings and autonomy level you choose; (b) your Customer Data and the communications you send or authorize through the platform, including any claim that a required consent was not obtained (such as under the TCPA or CAN-SPAM); (c) your products, services, jobs, pricing, and dealings with your customers, employees, and contractors; (d) your violation of these terms or of any law or third-party right; and (e) amounts you charge, refund, or fail to charge through connected payment processors.
We will notify you of a claim, let you control its defense with counsel reasonably acceptable to us, and reasonably cooperate at your expense; you will not settle a claim in a way that imposes any obligation on us or admits fault on our part without our prior written consent. This section survives termination of your account. Nothing in this Agreement requires you to indemnify us for liability to the extent caused by our own gross negligence, willful misconduct, or fraud.
You may stop using the service and close your account at any time. We may suspend or terminate access if you violate these terms or to protect the platform. On termination, your right to use the service ends; you may request an export of your data for a reasonable period.
We protect your account and data with industry-standard safeguards: encryption in transit (TLS), encryption at rest for sensitive secrets such as integration tokens and two-factor seeds (AES-256-GCM), hashed passwords, and per-business data isolation (row-level security). You can turn on two-factor authentication, review the devices where you are signed in, and sign out any of them from your Security settings (/account/security). Security is a shared responsibility: keep your credentials, authenticator device, and backup codes safe, and tell us promptly at support@binmaticai.com if you suspect unauthorized access. No method of transmission or storage is perfectly secure, but we work to safeguard your information and limit access to those who need it.
We may update these terms from time to time. Material changes will be posted here with an updated date; continued use after changes take effect means you accept them.
These terms are governed by the laws of Georgia, USA, without regard to conflict-of-laws rules.
